Terms of Service

These Terms set out the rules for using Book My Chair on the web and in our mobile app, including how bookings, payments, cancellations, loyalty rewards and reviews work.
1. About these terms and acceptance
These Terms of Service ("Terms") govern your access to and use of the Book My Chair platform, including our website at bookmychair.com.au and our mobile applications for iOS and Android (together, the "platform"). The website and app share the same backend, and these Terms apply to both.
By creating an account, downloading or using the app, or making a booking, you agree to these Terms. If you do not agree, please do not use the platform.
These Terms are between you and Book My Chair Australia ("Book My Chair", "we", "us" or "our").
2. Definitions
In these Terms:
- "Customer" means a person who uses the platform to find and book services.
- "Center" means an independent personal-care business that lists and provides services through the platform.
- "Staff" means a person who works at a center and provides services or manages bookings.
- "Booking" means a reservation made through the platform for a service provided by a center.
- "Content" means any information, text, images, reviews or other material submitted to the platform.
3. Eligibility and accounts
You must be at least 18 years old, or have the consent of a parent or guardian, to create an account.
You must provide accurate, current and complete information and keep it up to date. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Tell us promptly if you suspect any unauthorised use.
There are different account types — customer, center owner, staff and customer-service. Some features depend on your account type and the permissions assigned to you.
4. Licence to use the mobile app
We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the mobile app on a device you own or control, for your personal, non-commercial use (or, for centers and staff, to manage your business on the platform), subject to these Terms and the rules of the relevant app store.
You must not copy, modify, reverse-engineer, decompile, or create derivative works of the app, except to the extent the law permits you to do so.
Where you download the app from the Apple App Store: these Terms are between you and Book My Chair only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with the Apple App Store Terms of Service and applicable usage rules, and you confirm you are not located in a country subject to a relevant embargo and are not on a prohibited-parties list. Where you download the app from Google Play, you must comply with the Google Play Terms of Service.
5. The platform and our role
Book My Chair is an online marketplace that connects customers with independent centers. Centers are responsible for the services they list and provide.
Book My Chair is not the provider of the booked services and is not a party to the service contract between a customer and a center, except in our role as facilitator and payment processor. We do not control, and are not responsible for, the quality, safety, timing or legality of the services a center provides.
6. Bookings
When you make a booking, you offer to purchase the selected service at the listed price and time. A booking is confirmed once payment (or any required deposit) is successfully processed, and you will receive a confirmation by email and, where applicable, by SMS or push notification.
Prices, availability and service details are set by each center and may change. You are responsible for arriving on time and for providing accurate information for the booking, including a service address for at-home bookings.
7. Prices and payments
Prices are shown in Australian dollars (AUD) and may include a deposit payable at the time of booking, with the balance payable as described at checkout. Payments, deposits, balances and refunds are processed securely through Stripe; by paying, you also agree to Stripe’s terms.
You authorise us and Stripe to charge your chosen payment method for the amounts you agree to, including any deposit, the remaining balance, and any cancellation, no-show or other fees that apply under the center’s policy. Where a balance is collected after your appointment, you authorise that later charge to the payment method on file.
Where applicable, prices may include GST. Centers are responsible for issuing any tax invoice required for the services they provide.
8. Cancellations, reschedules and no-shows
Each center sets its own cancellation and reschedule policy, including any notice window and fee. The applicable policy is shown before you confirm a booking.
If you cancel late, reschedule outside the allowed window, or do not attend, a cancellation or no-show fee may be charged in accordance with that policy.
If you believe a fee was charged incorrectly, you can dispute it through our customer-service team, who will review the circumstances of the booking.
9. Refunds and your consumer rights
Refunds are handled in line with the relevant center’s policy and your rights under the Australian Consumer Law, which cannot be excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where a service is not delivered as described, or is otherwise faulty, you may be entitled to a remedy. Contact customer service and we will help resolve the issue with the center.
10. Loyalty rewards and promotions
A center may offer a loyalty program (for example, a reward after a set number of completed visits) or other promotions through the platform. Rewards are earned and redeemed according to the rules shown for that program at the time.
Loyalty rewards and promotional credits have no cash value, are not transferable, and cannot be exchanged for cash. We or the center may change, suspend or withdraw a program or promotion, subject to your rights under the Australian Consumer Law.
11. Reviews and user content
Only customers who have completed a booking may leave a review. Reviews and other content must be honest and must not be unlawful, misleading, defamatory, offensive, or infringe anyone’s rights.
You retain ownership of content you submit, but you grant Book My Chair a non-exclusive, royalty-free, worldwide licence to host, use, reproduce and display that content in connection with operating and promoting the platform. We may remove or moderate content that breaches these Terms.
12. Acceptable use
You must not misuse the platform. In particular, you must not:
- Attempt to gain unauthorised access to the platform, other accounts, or our systems.
- Interfere with, disrupt, or place undue load on the platform, or circumvent its security.
- Scrape, harvest or collect data from the platform except as expressly permitted.
- Use the platform to harass, defraud, impersonate or harm others, or for any unlawful purpose.
- Make bookings you do not intend to honour, or submit false reviews.
13. Intellectual property
The platform, including its software, design, text, graphics and logos, is owned by Book My Chair or our licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
14. Obligations of centers
Centers must hold all licences, registrations, qualifications and insurance required to provide their services, keep their listings, pricing and availability accurate, and honour confirmed bookings.
Centers must complete any verification we require before going live, and must keep their business and payout details accurate. To receive payments, centers must onboard with and maintain a connected Stripe account, and are bound by Stripe’s connected-account terms.
Centers are responsible for their own tax obligations, including GST registration, invoicing and reporting where applicable, and for complying with all laws that apply to their business and the personal information of their customers.
15. Communications
By using the platform, you agree that we may send you service communications by email, SMS and push notification, including booking confirmations, reminders, changes, receipts and security alerts. Marketing communications are sent only where permitted and can be opted out of, as described in our Privacy Policy.
16. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms. By using the platform, you acknowledge that we collect, use and disclose your information as set out in that policy.
17. Third-party services
The platform relies on third-party services, including Stripe (payments), Google (sign-in and mapping), and the Apple App Store and Google Play. Your use of those services may be subject to their own terms, and we are not responsible for them.
18. Suspension and termination
You may stop using the platform and close your account at any time. We may suspend or terminate your access if you breach these Terms, or if we reasonably believe your account is being used for fraudulent, unsafe or harmful activity, or as required by law.
Termination does not affect rights or obligations that arose before it, including payment obligations for completed bookings.
19. Disclaimers
The platform is provided on an "as is" and "as available" basis. To the extent permitted by law, and other than the guarantees that cannot be excluded under the Australian Consumer Law, we make no warranties that the platform will be uninterrupted, error-free or secure, or that listings, availability or center information will always be accurate.
20. Limitation of liability
To the extent permitted by law, Book My Chair is not liable for the acts or omissions of centers or customers, or for loss or damage arising from a service booked through the platform, and we are not liable for any indirect, incidental or consequential loss.
Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of doing so. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
21. Indemnity
To the extent permitted by law, you agree to indemnify Book My Chair against claims, losses and costs arising from your breach of these Terms, your misuse of the platform, or (for centers) the services you provide, except to the extent caused by our own breach or negligence.
22. Changes to the platform and these terms
We may update, add to, or remove features of the platform, and we may update these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you through the platform. Continued use after a change means you accept the updated Terms.
23. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State. If a dispute arises, we encourage you to contact us first so we can try to resolve it.
24. General
If any part of these Terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a sale or restructure of our business.
These Terms, together with our Privacy Policy and any policies referred to in them, are the entire agreement between you and Book My Chair about the platform.
